Terms of Service & Image Usage Rights

By purchasing a print or downloading an image from me, Rosemarie Skillman ("I," "me," "my"), you ("Customer," "you") agree to the following terms.

1. Ownership of Images

All photographic images, designs, and artwork made available on this site, whether as physical prints or free digital downloads (the "Content"), are my original work and are protected under U.S. and international copyright law. Purchasing a physical print or downloading a free image does not transfer ownership of the underlying image, copyright, or any intellectual property rights. I retain full and exclusive copyright ownership of all Content at all times.

2. What You're Purchasing

Your purchase grants you a physical, tangible print for personal use only, such as display in your home or office. It does not include any license to reproduce, scan, photograph, digitize, or otherwise copy the image, in whole or in part.

3. Act Now Free Downloadable Images

From time to time, I may offer select images as free digital downloads through my "Act Now" promotion. These downloads come with a limited license, separate from the print purchase terms above:

  • You may download and print the image for your own personal, non-commercial use (for example, printing a copy to hang in your home).

  • You may not sell, resell, or otherwise offer for sale any print, reproduction, or copy made from an Act Now download, in physical or digital form.

  • You may not use an Act Now image, or any print made from it, for any commercial purpose, including but not limited to the prohibited uses listed in Section 4 below.

  • This license is personal to you and non-transferable. You may not share, redistribute, or re-post the downloadable file itself.

  • I reserve the right to change, limit, or discontinue the Act Now promotion, or revoke access to a specific download, at any time.

All other terms in this document, including Sections 4 through 11, apply equally to images obtained through the Act Now promotion.

4. Prohibited Uses

You may not, under any circumstances:

  • Reproduce, copy, scan, or digitize a print or downloaded image in any format beyond what's expressly permitted above

  • Use the image (or a print made from it) in the background, set, or props of any commercial photography, film, video, advertisement, or other production

  • Use the image in any print or digital publication, product, packaging, signage, or merchandise

  • Resell, sublicense, rent, or otherwise distribute the image or reproductions of it

  • Use the image for any commercial purpose whatsoever

  • Alter, crop, or create derivative works from the image

  • Remove or obscure any watermark, signature, or copyright notice on the print or downloaded file

Any use beyond personal, non-commercial use requires separate written licensing permission from me. Contact me at Rose@RosemarieSkillman.com to inquire about licensing.

5. No Profit / Non-Commercial Use

Prints and Act Now downloads obtained through this site are for the Customer's personal enjoyment only. No profit may be made from the image, any print of it, or any reproduction of it, whether sold, licensed, rented, or otherwise monetized.

6. All Sales Final

All sales are final. I do not offer refunds, exchanges, or cancellations once an order has been placed, except as described in Section 7 below. (This does not apply to Act Now downloads, which are free and non-refundable by nature.)

7. Damaged or Defective Prints

If your print arrives damaged, defective, or materially different from what was ordered, you must notify me within 7 days of receipt at Rose@RosemarieSkillman.com. Include your order number and photos of the issue. Claims submitted after 7 days will not be eligible for a remedy. Once approved, I will reprint and reship the item at no additional cost to you.

8. Limitation of Liability

Prints and downloaded images are provided "as is." To the fullest extent permitted by law, I am not liable for any indirect, incidental, or consequential damages arising from the purchase, download, or use of an image. My total liability for any claim related to your order will not exceed the amount you paid for that order.

9. Enforcement

Unauthorized use of my Content, including any use prohibited under Sections 3 or 4, may result in legal action, including claims for copyright infringement, statutory damages, and recovery of attorneys' fees.

10. Changes to These Terms

I may update these Terms at any time. Continued use of this site, future purchases, or future downloads after changes are posted constitutes acceptance of the revised Terms.

11. Governing Law

These Terms are governed by the laws of the State of Colorado, without regard to conflict of law principles. Any disputes shall be resolved in the courts located in Rio Grande County, Colorado.
